- Acceptance of Terms
By accessing or using Doveria Pty Ltd’s (ABN: 83 110 049 119) software, tools, or services (“Services”), you agree to comply with these Terms of Service (“Terms”). These Terms apply to all aged care providers, staff, and affiliated users (“Customers”).
- Scope of Services
Doveria provides IT solutions to assist aged care providers in:
- Workforce management and rostering,
- Compliance reporting (e.g., AN-ACC, Aged Care Quality Standards),
- Data analytics and cybersecurity,
- Integration with third-party aged care systems.
Note: Doveria’s software supports compliance efforts but does not guarantee adherence to legislative requirements. Customers remain responsible for verifying outcomes.
- User Obligations
Customers agree to:
- Use Services only for lawful purposes under the Aged Care Act 1997 and related regulations.
- Ensure staff complete mandatory training (e.g., infection control, SIRS reporting) where applicable.
- Maintain accurate records for audits by the Aged Care Quality and Safety Commission.
- Notify Doveria immediately of suspected security breaches or misuse of the platform.
- Data Privacy & Security
- Compliance: Doveria adheres to the Privacy Act 1988 (APPs) and My Health Records Act 2012when handling personal or health information. Sensitive data (e.g., resident records) is encrypted and stored in Australian data centres.
- Cybersecurity: We implement the Essential Eight mitigation strategies and conduct annual penetration testing.
- Breach Notification: Doveria will notify Customers of confirmed data breaches affecting resident privacy within 72 hours, per the Notifiable Data Breaches Scheme.
- Intellectual Property
- Doveria retains ownership of all software, code, and content. Customers receive a non-exclusive, non-transferable license to use the Services.
- Customers grant Doveria limited rights to anonymized data for system improvements.
- Liability & Disclaimers
- No Guarantee of Compliance: Doveria’s tools are designed to assist with aged care obligations but do not replace legal or clinical advice.
- Limitation of Liability: To the extent permitted by law, Doveria excludes liability for indirect losses (e.g., operational downtime, fines for non-compliance).
- Third-Party Tools: Doveria is not responsible for errors in third-party integrations (e.g., My Aged Care portals, clinical systems).
- Termination
Doveria may suspend or terminate access if:
- Customers breach these Terms or misuse the Services.
- Required by law (e.g., non-payment, fraudulent activity).
- Termination does not relieve Customers of outstanding fees.
- Governing Law & Disputes
- These Terms are governed by the laws of [Insert State/Territory], Australia.
- Disputes will first be resolved through mediation via the Australian Disputes Centre.
- Updates to Terms
Doveria may revise these Terms to reflect legislative changes (e.g., updates to the Aged Care Act). Customers will receive 30 days’ notice via email or in-platform alerts.
